In respect of a lawsuit in which Noda Shokukin Kogyo Co., Ltd. (Noda) filed an action for patent infringement and payment of damages against two companies, the Aminoup Co., Ltd. (Aminoup) and Daiwa Pharmaceutical Co., Ltd. (Daiwa), the Tokyo District Court issued a judgment stating that the claims of the plaintiff shall be dismissed and the two companies as the defendants have won this litigation.

The Noda claims were that manufacture and distribution of AHCC, one of Aminoup's products, should be suspended and the product disposed of with a payment of 100 million in damages on the grounds that the product was developed by a process that infringed the patent held by Noda. Those related to Daiwa were that their manufacture and sale of "Lentin Plus 1000" should be suspended and the company should pay 16 million in damages.

The text of the sentence includes the statements that :

1. Any claims made by the plaintiff shall be dismissed, and
2. The cost of litigation shall be borne by the plaintiff. Thus, the plaintiff's claims were rejected completely.

This lawsuit is " No. 11391 (Wa) 1997, A Case for Suspension of the Patent Infringement." The decision was given on February 16, 2000, whose original copy was received on the same day.
